GENERAL TERMS OF SALE AND USE OF THE STRASBOURG AIRPORT PARKING SPACE BOOKING SERVICE

These general terms of sale define the terms and conditions applicable to the use of the online parking space booking service offered by Aéroport de Strasbourg. The use of this service automatically implies acceptance of these General Terms of Sale. These provisions shall prevail over any other document and are those in force on 27 June 2016. They may be updated by Strasbourg Airport.

Article 1 – Scope and description of the service

These General Terms of Sale govern all relations between the company Aéroport de Strasbourg Entzheim, public limited company ("société anonyme") with board of directors and supervisory board, with capital of 148,000 Euros, with registered office at RD 221, Route de l’Aéroport 67960 ENTZHEIM, registered with the Trade and Companies Register of Strasbourg under the number 528862956 (hereinafter "Strasbourg Airport"), and any Customer placing an order on the website: parking.strasbourg.aeroport.fr

The service offered is the booking of a parking space via the parking.strasbourg.aeroport.fr website, for a given car park for which the service is offered, for a given person, a precise date and a period of time defined in advance. This offer is made on the basis of a limited number of parking spaces, and the offer is therefore limited to the number of spaces available at the time of making the request.

Only Customers who have booked in advance on the website may benefit from this service.

Article 2 – Conditions of booking a parking space

Any physical and/or legal person legally capable of entering into a contract may use this service.
The Customer of the service must complete the mandatory fields in the subscription for provided on the website. Strasbourg Airport reserves the right to refuse a subscription to this service if the information provided is erroneous or incomplete.

Bookings will be validated subject to:

Parking spaces may only be booked a maximum of 6 months and a minimum of 24 hours before the planned date of entry of the vehicle.

This service gives a right to a prepaid parking space for a given period.

The service offers the possibility of booking a space for a minimum of 48 hours.

It should be noted that:
1. The car parks can accommodate vehicles up to a maximum height of 2.20m.
2. Disabled spaces for people with reduced mobility cannot be booked online.

Article 3 – Booking conditions

The booking is paid for at the time of subscribing to the service on the internet.

Once the booking form has been duly completed, the booking validated and the payment made, the customer receives a confirmation e-mail at the address provided at the time of booking, containing a summary of the order and the booking number to quote.

On no account, even in the event of a complaint having been lodged, may the Customer withhold all or part of the sums owed or offset any sums. All orders must be paid immediately and will be debited as soon as they are accepted.

If the payment is found to be incorrect, incomplete or non-existent, for any reason whatsoever, the sale of the service cannot go ahead.

Bills are issued on the basis of the information provided by the Customer in the booking form and are sent to the Customer at his/her e-mail address, after payment.

Article 4 – Conditions of use

Upon arrival at the airport, the Customer shall drive up to one of the entry terminals of the reserved car park, the vehicle will be recognized by the entry terminal according to the licence plate number entered when ordering: the barrier automatically issues a ticket.

The Customer shall enter the car park and park his vehicle in a space marked on the ground, in accordance with the rules relating to spaces set aside for persons with reduced mobility.

Upon return, the customer will scan the received ticket at the exit of the car park. If the parking time is as booked, the barrier will open straight away. If the booked time has expired, additional parking charges will be displayed on the exit terminal and shall be paid by bank card.

It is the customer's responsibility to allow enough time between the time of arrival of the flight and the car park exit time (time to get to the terminal, retrieve luggage, waiting time, etc.). Strasbourg Airport may not be held liable for any exceeding of the parking period booked connected with external events or their consequences.
Strasbourg Airport reserves the right to change, during the year, the car park for which the booking is made, as well as the dates when the service is valid.

Parking will only be allowed on the car park for which the booking is made. Any parking on a different car park for the same period will be charged at the rate displayed at the entrance to the car park, and no refund will be given.
Once a vehicle leaves the car park, it will not be able to return.

Article 5 – Rates and terms of payment

The parking space booking service is subject to immediate payment at the time of placing the order and payment may only be made by credit card.

The cards accepted are listed on the site. The amount debited is a flat amount corresponding to the particulars of the booking (dates, duration, car park, any options, etc.).

Prices are in Euros and inclusive of VAT as applicable on the day of booking (unless specified otherwise).

Strasbourg Airport reserves the right to change the prices quoted on its website at any time, without prior warning, it being understood that such changes will not apply to bookings already validated.

The exit of the park will be by reading the license plate. Any overstay will require the payment of a supplement calculated at the hourly rate in force in the car park in question. It will not be possible to leave the car park without paying the supplement.

Tickets can only be validated and overstay supplements be paid at one of the pay stations.

Article 6 – Withdrawal period

Booking a parking space on the internet constitutes the remote provision of a service. Under Article L. 121-21 of the French Consumer Code, the customer has a withdrawal period of fourteen (14) clear days to change his mind without having to give a reason or pay a penalty. This period runs from the acceptance of the offer.

Under Article L. 121-21-8-1 of the French Consumer Code, the customer may not make use of this right when the service ordered has begun with his agreement before the end of the withdrawal period, and he has expressly waived the latter.

The customer will be refunded by crediting the amount directly to the bank account to which the card used to make the booking is attached.

Article 7 – Changes and cancellations

The customer has the possibility of changing his booking once only or of cancelling it up to 24 hours before the date and time of the booking, by clicking on the link in confirmation e-mail received.

Beyond this deadline of 24 hours, no refund will be made in case of cancellation or not recovery of the booked parking cheque.

There is no extra charge for changing a booking. If the charge for the new booking is less than that of the original booking, his account will be credited with the difference, within a maximum of one month. If the amount is greater, he must pay the difference online at the time of confirming the change.

With the exception of cancellations made within the 14-day statutory cooling-off period following the purchase, all cancellations are subject to a €10 VAT incl. administration charge.

Article 8 – Liability – Insurance

The customer has a duty to comply with the Car Park Rules, which can be consulted on the www.strasbourg.aeroport.fr website, the Highway Code and these General Terms of Sale.

In the event of any contradiction between one of the provisions of these General Terms of Sale and one of the Car Park Rules, these General Terms of Sale shall prevail.

In accordance with Article L.121-20-3 of the French Consumer Code, Strasbourg Airport declines any liability in the event of the non-performance or poor performance of the service which can be attributed either to the customer or to the actions of any third party not involved in the service or to a case of force majeure.

The customer waives all recourse against Strasbourg Airport and its insurers in the event of the use by a third party or the fraudulent use of his/her booking number.

In the event of the contract not being fulfilled due to the unavailability of the service ordered, the customer must be informed of that unavailability and must, where applicable, be refunded without delay and at the latest within thirty days of his payment of the charge.

Furthermore, Strasbourg Airport may not be held liable in the event of:
Internet disruptions and outages affecting the use of the parking.strasbourg.aeroport.fr website;
Malfunctions caused by third party software;
External intrusions or the presence of viruses on the Customer's computer.

In accordance with the Car Park Rules in force, the customer parks his car at his own risk, as payment covers only parking and not guarding or surveillance. Strasbourg Airport declines any liability for damage, accidents to or theft from the vehicle and any or all of the objects and equipment contained therein.

The Highway Code applies on the car parks. Any breach of the traffic and parking rules is liable to a fine or the removal of the vehicle to the pound.

Article 9 – Data protection

Strasbourg Airport reserves the right to collect nominative information and personal data necessary to the improvement of order handling and commercial relations.

Under the provisions of French data protection law, Law no. 78-17 of 06/01/1978 amended, any person whose details are contained in the computer files held by Strasbourg Airport has a right of access and rectification of the information concerning him/her.

These General Terms of Sale are governed by French law. In the event of any dispute arising as to the interpretation or execution of these General Terms of Sale, it will be submitted to the courts with jurisdiction.
